Terms of Service
Effective Date: March 7, 2026
This End User License Agreement (“Agreement”) is a legal agreement between you (“User,” “you”) and Austin Arborist Company dba Austin Tree Experts (“Company,” “we,” “us”) governing your use of our website, online tools, customer portal, and integrated services including QuickBooks Online invoicing and payment processing (collectively, the “Service”).
By accessing or using the Service, you agree to be bound by this Agreement. If you do not agree to these terms, do not use the Service.
1. Services Provided
Austin Tree Experts provides professional tree care services including pruning, removal, planting, consulting, and related arboricultural services in the Austin, Texas metropolitan area. Our website and online tools are provided to support these services, including:
- Requesting quotes and scheduling services
- Interactive tools (Jurisdiction Finder, Mulch Calculator, Tree Appraisal Calculator)
- Customer portal for account access, invoicing, and payment
- Communication regarding your tree care services
2. QuickBooks Online Integration
Our Service integrates with QuickBooks Online (“QBO”) to manage customer invoicing and payment processing. When you engage our services and authorize payment, the following data may be synchronized with QuickBooks Online:
- Your contact information (name, address, phone, email) as a customer record in QBO
- Invoices generated for tree care services performed
- Payment records and notifications received via QBO webhooks
This integration is governed by Intuit’s own terms of service and privacy policy. You may request disconnection of your data from our QuickBooks integration at any time by contacting us.
3. Customer Portal Access
If you are provided login credentials for our customer portal, you are responsible for maintaining the confidentiality of your account information and for all activity under your account. You agree to notify us immediately of any unauthorized access or use of your account.
4. Acceptable Use
You agree not to use the Service to:
- Engage in any unlawful activity or violate any applicable laws or regulations
- Attempt to gain unauthorized access to any part of the Service or its related systems
- Reverse engineer, decompile, or disassemble any portion of the Service
- Interfere with or disrupt the integrity or performance of the Service
- Submit false or misleading information in quote requests or service inquiries
5. Tree Service Terms
Estimates provided through our website or in person are subject to change upon on-site assessment. Final pricing, scope of work, and service terms are governed by the written proposal or contract provided before work begins. This Agreement does not supersede any signed service contract between you and Austin Tree Experts.
6. Intellectual Property
The Service, including its design, content, tools, code, and documentation, is the property of the Company and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the Service without our written permission.
7. Data Ownership
You retain ownership of all personal and property information you provide to us. Our collection and use of your data is governed by our Privacy Policy.
8. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
Information provided by our online tools (Jurisdiction Finder, Mulch Calculator, Tree Appraisal Calculator) is for estimation purposes only and should not be relied upon as a substitute for professional arboricultural assessment.
9. Limitation of Liability
To the maximum extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Service.
10. Third-Party Services
The Service integrates with third-party platforms including QuickBooks Online and Google Maps. These services operate under their own terms and privacy policies. We are not responsible for the availability, accuracy, or practices of any third-party services.
11. Termination
We may suspend or terminate your access to the Service at any time, with or without cause. Upon termination, your right to use the Service ceases immediately. Sections 8, 9, and 12 of this Agreement shall survive termination.
12. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under this Agreement shall be resolved in the courts of Travis County, Texas.
13. Changes to This Agreement
We may update this Agreement from time to time. Changes will be posted on this page with a revised effective date. Continued use of the Service after changes are posted constitutes your acceptance of the revised Agreement.
